1. Agreement to Terms
By accessing or using the website located at https://www.donleefarms.com/ (the “Site”), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Don Lee Farms (“Company”, “we”, “us”, or “our”), concerning your access to and use of the Site. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and you must discontinue use immediately.
2. Use of Site
You agree to use the Site only for lawful purposes and in compliance with all applicable laws. We reserve the right to restrict or terminate your access at any time for violations of these Terms.
3. Intellectual Property
All content on the Site, including but not limited to text, graphics, images, logos, trademarks, and videos (collectively, the “Content”), is owned by or licensed to the Company and is protected by copyright and trademark laws. No reproduction, distribution, or creation of derivative works is permitted without our prior written consent.
4. Product Information & Availability
Products shown on the Site may not be available in all locations or at all times. All information regarding packaging, ingredients, and specifications is subject to change without notice. Always rely on the physical product packaging for the most current and accurate information. Product availability is not guaranteed.
5. User-Submitted Content
By submitting content to the Site (e.g., reviews, messages, or inquiries), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display that content in connection with our business. You are solely responsible for the content you submit and must ensure it does not violate any third-party rights. We reserve the right, at our sole discretion, to remove or edit any user submissions.
6. Disclaimer of Warranties
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DON LEE FARMS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100.00) OR THE AMOUNT YOU PAID, IF ANY, FOR PRODUCTS OR SERVICES PURCHASED FROM THIS SITE.
8. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, arising out of your use of the Site or your violation of these Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
10. Dispute Resolution: Binding Individual Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, WAIVES THE RIGHT TO A JURY TRIAL AND TO CLASS OR REPRESENTATIVE ACTIONS, AND REQUIRES AN INFORMAL RESOLUTION PROCESS FIRST. YOU MAY OPT OUT AS DESCRIBED IN SECTION 10.H.
A. Informal Resolution First. Before starting an arbitration or court proceeding, you and we each agree to send the other a written, individualized Notice of Dispute. Your Notice must be submitted through our Notice of Dispute page or emailed to ask@donleefarms.com, and must include: your name, mailing address and email; a description of the dispute, including the facts of your own use of the Site; the relief you seek, with a calculation of any claimed damages; and your personal signature (a typed full legal name is acceptable). Each Notice may concern only one person; a Notice covering multiple people is not valid as to any of them. Our Notice to you will be sent to the contact information we have for you. For 60 days after a complete Notice is received, the parties will try in good faith to resolve the dispute informally, and either side may request an individualized video conference. Completing this process is a condition precedent to starting an arbitration or court action. All statutes of limitations and filing-fee deadlines are tolled while it is pending. A court may enforce this Section 10.A, including by enjoining an arbitration or lawsuit started without completing it.
B. Agreement to Arbitrate. Except as provided in Section 10.D, any dispute, claim, or controversy between you and Don Lee Farms arising out of or relating to the Site, these Terms, or our Privacy Policy, including claims about how the Site collects, uses, or shares information, and whether based on contract, statute, tort, or any other legal theory (a “Dispute”), will be resolved by final and binding individual arbitration. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this Section 10.
C. Administrator, Rules & Fees. The arbitration will be administered by National Arbitration and Mediation (“NAM”) under its Comprehensive Dispute Resolution Rules and Procedures and, where applicable, its Supplemental Rules for Mass Arbitration Filings, in effect when the arbitration is filed (available at namadr.com), as modified by this Section 10. If NAM is unavailable or declines to administer, the parties will agree on another nationally recognized administrator, or a court will appoint one under 9 U.S.C. § 5. A single arbitrator will decide the Dispute. Hearings will take place by video conference or in the county where you live, and claims of $10,000 or less will be decided on written submissions unless the arbitrator decides a hearing is necessary. Payment of administrative and arbitrator fees will be governed by the administrator’s rules, and for claims brought by an individual consumer we will pay the fees those rules require a business to pay. The arbitrator may award, on an individual basis, any relief that would be available in court, but only in favor of the individual party seeking relief and only to the extent necessary to provide relief on that party’s individual claim. The arbitrator decides all issues except that a court has exclusive authority to decide whether Sections 10.A, 10.E, 10.F, and 10.G are enforceable and have been complied with.
D. Exceptions. Either party may bring an individual action in small claims court for any Dispute within that court’s jurisdiction, as long as it stays there on an individual basis. Either party may also seek injunctive relief in court to stop infringement or misuse of its intellectual property.
E. Class Action and Jury Trial Waiver. YOU AND DON LEE FARMS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Unless both parties agree in writing, the arbitrator may not combine more than one person’s claims (except as provided in Section 10.G) and may not preside over any class, collective, or representative proceeding. YOU AND DON LEE FARMS EACH WAIVE THE RIGHT TO A JURY TRIAL.
F. Public Injunctive Relief. Nothing in this Section 10 waives any right you may have to seek public injunctive relief (relief whose primary purpose and effect is to prohibit unlawful acts that threaten future injury to the general public) to the extent such a waiver would be unenforceable under applicable law. Any such request will be severed from the arbitration and decided by a court in Los Angeles County, California, only after the arbitration of all individual claims and remedies is complete, and the court action will be stayed until then.
G. Mass Filings. If 25 or more Notices of Dispute or demands for arbitration raising substantially similar Disputes are submitted by or with the assistance of the same or coordinated counsel or organizations, they will be administered under NAM’s Supplemental Rules for Mass Arbitration Filings, including its batching procedures, and statutes of limitations will be tolled for any claim while it awaits administration. If this Section 10.G is found unenforceable as to any group of filings, those Disputes will be resolved individually in court, not in arbitration, and Section 10.E will continue to apply to the extent enforceable.
H. 30-Day Right to Opt Out. You may opt out of this agreement to arbitrate by emailing ask@donleefarms.com with the subject line “Arbitration Opt-Out” and your name and email address within 30 days after you first agree to these Terms. Opting out does not affect any other part of these Terms.
I. Changes to This Section. If we change this Section 10, the change will not apply to any Dispute for which a Notice of Dispute was sent before the change was posted. You may reject a material change by emailing ask@donleefarms.com within 30 days after it is posted, in which case the most recent version you accepted continues to apply to you.
J. Severability & Survival. If any part of this Section 10 other than Section 10.E is found unenforceable, that part will be severed and the rest will remain in effect. If Section 10.E is found unenforceable as to any claim, that claim, and only that claim, will be decided by a court in Los Angeles County, California, and not in class or representative arbitration. This Section 10 survives the end of your use of the Site.
K. Courts. For any Dispute not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California.
11. Modifications to Terms
We reserve the right to update or modify these Terms at any time. The “Last Updated” date at the top of this page will be revised upon any changes. Your continued use of the Site after such changes constitutes your acceptance of the new Terms, except that changes to Section 10 are governed by Section 10.I.

6. Cookies & Tracking Technologies
We do not set tracking cookies and do not load third-party analytics, advertising, or session-recording technologies in your browser. We measure general site traffic using server logs on our own hosting infrastructure, which involves the standard technical receipt of your IP address and requested page by our web server in order to deliver the Site to you. Our hosting provider (Netlify) may also run a small performance-measurement script in your browser that records page-load timing, such as how quickly a page renders. We use it only in aggregate to keep the Site fast, not for advertising, profiling, or cross-site tracking. If you submit a form (for example, to join our email list or contact us), the information you provide is transmitted to our service providers solely to fulfill your request, as described above. We honor Global Privacy Control (GPC) signals; because we do not sell or share personal information and do not deploy non-essential tracking, no additional action is triggered by a GPC signal, but we treat it as an opt-out of any future sale or sharing.
7. Children’s Privacy
This Site is not intended for children under the age of 13. We do not knowingly collect data from them. If we become aware that such collection has occurred, we will take steps to delete the information promptly.
8. Data Retention & Security
We keep personal information only as long as reasonably necessary for the purpose it was collected. For each category, we use the following criteria:
- Identifiers and messages you send us (contact forms, emails, sample or information requests): for as long as needed to respond and to maintain any resulting business relationship, and afterward for as long as reasonably needed to handle follow-up questions, product or food-safety matters, and potential legal claims within the applicable limitation periods.
- Email list: until you unsubscribe. After that, we keep only your email address on a suppression list so we do not email you again.
- Internet activity and approximate location (server and performance logs): for our hosting provider’s standard log-retention period, after which the logs are deleted automatically.
- Commercial information (product inquiries and complaints): for as long as needed to resolve the matter and for any period required by food-safety, recall, or other recordkeeping laws.
- Privacy requests and Notices of Dispute: for as long as needed to resolve the matter and the applicable limitation period, and at least 24 months for privacy-request records as California regulations require.
We may keep information longer when required by law or to preserve evidence for a pending or reasonably anticipated legal claim. We have implemented reasonable administrative, technical, and physical safeguards to protect your information, but no system can guarantee absolute security.

The Site may contain links or tools from third parties (e.g., social media plug-ins). We are not responsible for their privacy practices; please review their policies before engaging with them.

We do not guarantee its accuracy or completeness. Formulations may change. Always refer to the physical product packaging for the most current and accurate information.
2. Allergen & Cross-Contamination Advisory
Our products are manufactured in facilities that handle the major food allergens recognized under U.S. law: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans, and sesame (added as the ninth major allergen under the FASTER Act of 2021, effective January 1, 2023). Allergens are declared on our packaging in accordance with applicable FDA (FALCPA) and USDA/FSIS labeling regulations. Because items are produced on shared equipment and lines, we cannot guarantee that any product is entirely free from allergens, cross-contact, or trace ingredients. Accessibility Statement
Don Lee Farms is committed to making our website accessible to everyone, including people with disabilities. We want all visitors to be able to find information about our products, our company, and how to reach us, regardless of how they access the web.
Our Conformance Goal
We aim to conform to the World Wide Web Consortium’s Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. These guidelines explain how to make web content more accessible for people with a wide range of disabilities, including visual, auditory, physical, speech, cognitive, and neurological disabilities. We treat WCAG 2.1 AA as our working standard and review the Site against it on an ongoing basis.
Measures We Take
To support accessibility, we have built and continue to maintain this Site with the following practices in mind:
- Semantic HTML structure and a defined page language to support assistive technologies such as screen readers.
- Descriptive alternative text for meaningful images, with decorative images marked so they are skipped by screen readers.
- Keyboard-operable navigation, visible keyboard focus styles, and “skip to content” links.
- Form fields with associated labels so they can be identified by assistive technologies.
- Respect for the “reduced motion” setting so animations are minimized for visitors who prefer less movement.
- Captioned or context-described video where applicable, and pages designed to remain usable when zoomed or viewed on small screens.
Ongoing Effort & Known Limitations
Accessibility is an ongoing effort rather than a one-time project. We periodically review the Site, including with automated and manual testing, and work to remediate issues we identify. Despite our efforts, some content or third-party features may not yet be fully accessible. Where we rely on third-party tools, embedded content, or external links, those elements may not be under our direct control, and we encourage you to contact those providers directly. If you encounter a barrier, we want to hear about it so we can address it.
Feedback & How to Reach Us
If you have difficulty accessing any part of this Site, or if you have a question, comment, or request related to accessibility, please contact us. We welcome your feedback and will make reasonable efforts to provide the information, item, or transaction you are seeking through an accessible communication method.
